이스라엘을 유엔에서 제명하는 것이 국제 법체계의 무결성을 보존하는 유일한 길이다.

우리는 국제법, 국제관계, 갈등 연구, 정치학, 제노사이드 연구의 학자와 전문가로서 유엔 총회와 그 회원국들에게 이스라엘을 최대한 빠르게 총회에서 제명할 것을 촉구한다. 이는 유엔 헌장과 국제 법질서의 신뢰성과 정당성을 보호하기 위한 조치이다.
이스라엘은 유엔과 국제 법체계에 대해 지속적인 무시와 경멸의 태도를 보여 왔다. 이는 팔레스타인의 귀환권을 보장한 1948년 결의 194(III)와 팔레스타인 국가 주권을 명시한 1947년 결의 181(II)을 무시하면서 시작되었다. 1949년 결의 273(III)을 통해 유엔에 가입할 당시 이스라엘 대표들은 이러한 결의들을 존중할 것을 약속했으며, 이는 타국 및 유엔 대표들이 이스라엘의 가입 조건으로 여긴 바이다.
수십 년 동안 이스라엘은 총회 결의와 2004년 국제사법재판소(ICJ) 권고 의견을 경멸하며, 팔레스타인인의 자결권을 존중하고 점령 팔레스타인 영토(OPT)에 대한 이스라엘의 병합과 식민화를 규탄하는 결의를 무시해왔다. 최근 ICJ 권고 의견은 이스라엘이 팔레스타인인의 자결권과 귀환권을 체계적으로 방해하고 있음을 확인했다. 또한 이스라엘은 다수의 안보리 결의를 반복적으로 무시했으며, 이는 유엔 헌장 제25조를 위반하는 행위다. 유엔 헌장 제6조에 따라, 안보리의 권고를 받아 총회는 이스라엘을 헌장 원칙의 지속적 위반으로 인해 제명할 수 있다.
이스라엘은 UNRWA와 UNIFIL 같은 유엔 기구에 제공된 보호를 반복적으로 침해하며 유엔 직원의 사망을 초래하고 유엔 시설을 폭격한 바 있다. 게다가 유엔 메커니즘에 협조를 거부하며 유엔 사무총장, 유엔 특별보고관, 유엔 독립 조사위원회 등의 방문을 거부해 왔다. 유엔 내부에서도 이스라엘은 유엔을 향한 비방 발언을 반복하고 있다. 이러한 행동들은 유엔 체제에 대한 완전한 무시를 반영하며, 국제법을 위반하는 것이다.
이스라엘은 팔레스타인인의 자결권을 체계적으로 부정하고 팔레스타인 영토를 끊임없이 탈취하여, 지금 이스라엘이 팔레스타인인에 대한 제노사이드와 민족청소를 잔혹하고 전례 없이 강력하게 진행하고 있는 중요한 역사적 기로에 놓여 있다. 팔레스타인인들의 존재 자체는 이스라엘의 책임 추궁을 통해서만 유지될 수 있으며, 마침내 이들의 정치적, 사회적, 경제적 운명을 스스로 결정할 권리를 실현할 수 있다. 또한, 이스라엘의 불법 행위가 국제 법체계의 정당성에 중대한 의문을 제기하며, 그 무결성을 위협하고 있다.
총회와 회원국들은 팔레스타인인의 자결권과 국제 법체계의 무결성을 위한 실질적 조치를 지체 없이 이행해야 하며, 총회에서 이스라엘 정부를 제명함으로써 이 권한을 행사해야 한다.
국가 정부의 대표단을 제명하는 것은 예외적 조치지만, 이 경우는 법적 근거가 있으며, 1974년 남아프리카 공화국의 아파르트헤이트 정부를 총회에서 제명한 전례에 따라 이루어질 수 있다. 50년 전, 총회는 자국의 흑인 인구에게 대표성을 제공하지 않아 비정당적이었던 남아공 정부를 대표 자격에서 박탈했으며, 이는 암묵적으로 자결권을 인정한 조치였다.
2024년 7월 19일 ICJ의 OPT 내 이스라엘 정책 및 관행에 관한 권고 의견에 따르면, 이스라엘 정부의 대표성이 부족하다는 이유로 제명할 근거는 남아공과 동등하거나 그 이상이다.
권고 의견에 따르면, 총회와 회원국은 팔레스타인인의 자결권을 실현할 법적 의무가 있으며, 이는 강행규범(jus cogens) 및 모든 국가에 대해 효력을 가지는 의무(erga omnes)이다. 따라서 법적으로 총회가 자격 심사를 통해 이 의무를 실현할 수 있는 길이 열려 있다.
우리는 이미 총회와 회원국들이 권고 의견에 따른 책임을 수행하기 위해 취한 조치를 인정한다. 특히, 2024년 9월 18일 총회는 이스라엘이 권고 의견을 12개월 내에 준수할 것을 요구하는 결의를 통과시키며, "OPT에서의 불법적인 존재를 즉시 종료하고, 팔레스타인인의 자결권 행사 방해를 중단할 것" 등을 촉구했다. 이 결의는 또한 "모든 국가와 유엔, 유엔 산하 기구 및 지역 기구들이 팔레스타인인의 자결권 조기 실현을 지원하고 권고 의견 및 관련 유엔 결의의 완전한 이행을 위해 적극적 조치를 취할 것"을 요구한다.
우리는 총회와 회원국들이 권고 의견의 "완전한 이행"과 팔레스타인인의 자결권 실현을 위해 모든 필요한 조치를 취하여 이스라엘 정부를 총회에서 제명할 것을 강력히 촉구한다.
이스라엘이 유엔 헌장의 취지에 반하여 국제 평화와 안전을 위협하는 심각한 불법 행위를 저지르며 총회에 계속 참여하도록 허용하는 것은 국제 법질서의 정당성 위기를 악화시킨다. 반면, 이스라엘 국가를 제명하는 것은 총회와 유엔 전체가 80년 전 유엔 설립 당시 세운 권리와 원칙을 수호하는 데 여전히 헌신하고 있음을 나타내는 상징적 신호가 될 것이다.
이스라엘 제노사이드 2주년, 가자지구 및 요르단강 서안 지구(동예루살렘 포함) 점령 57주년, 수십만 팔레스타인인이 역사적 팔레스타인에서 추방된 지 76주년을 맞아, 이스라엘을 총회에서 제명하는 것은 ICJ 권고 의견에 따른 총회 및 회원국의 법적 책임을 이행하는 것일 뿐만 아니라, 팔레스타인인들이 인간다운 삶과 자유를 실현할 수 있는 가능성을 오랫동안 훼손해온 이스라엘의 책임을 묻는 의미 있는 조치가 될 것이다. 이 조치는 팔레스타인 민중의 보호와 해방을 위한 중요한 진전이 될 것이다.
